Documents Required Under NRC


The creation of Citizenship Amendment Act has set off protest across the country. The act that is passed to address the humanitarian  needs, is facing lots of oppose which is probably due to confusion between CAA and NRC.
I have already discussed about CAA in my previous article. Here we will try to understand, What is NRC? History of NRC and about the documents required under NRC. The information here provided is based on NRC rules in Assam.The NRC bill which is expected to be proposed in 2024, is said to be more lenient in comparison to it is now in Assam.

NRC & Its History:

The National Register of Citizens (NRC) is the register containing names of Indian Citizens. First time the NRC was prepared in 1951 using the data that was obtained in 1951 census. Also its creation is mandated by The Citizenship Act 1955. 
The need of NRC was felt because problem of illegal migrant (through infiltration) was rising since it is the border state and hence in 1951 the NRC was prepared.  Also an act  on illegal migrant, Illegal Migrants Act passed in 1983, was found unconstitutional by supreme court of India and was knocked down in the year 2005 and therefore the government then wanted to update the NRC register. But due to unsatisfactory progress Supreme court of India decided to monitor  on its own in the year 2013.

Present Case of NRC :

NRC was brought under amendment in the year 2003 and  2009, which made some documents compulsory to prove Indian citizenship and also enabled it to be applicable all over the nation.
Still it has not been applied nor proposed to  do so. But yes, as per its promise in election manifesto the current government will apply it all over the nation. The government has promised Indian Muslims that it won't take away their rights and won't cause injustice to them. In order to assure it, government is planning to propose bill in 2024, instead of 2021.

In spite of this  there is lot of chaos  around the nation, due to forecast of certain people an political party leaders who are willing to take advantage of it by confusing the people. People are also reacting on the basis of anticipation of opposition party leaders.
Hence I am here providing some information on the basis of NRC rules in Assam and some information obtained from various sources. Instead of reacting the educated population is supposed  to respond, talk and express itself in sensible and responsible way. Since lots of people are under confusion its time to clear them. This article is just an effort to make everyone aware of actual fact. 

There are two lists under NRC, namely List A & List B. List A has thirteen (13) documents and list B has 8 documents.
If a person is successful in providing even ANY ONE of the document from the list A, he/she will not have to produce any other further document. The second requirement arises if name in any of the documents  of List A is no of the applicant himself/herself but that if of the ancestor, namely father or mother or grandfather or grandmother (and so on) of the applicant .In such cases, the applicant shall have to submit documents as in the list B below to establish relationship with ancestor i.e., father or mother or grandfather or grandmother etc. whose name appears in the list A. 

List A includes:

  1. Electoral roll(s) up to march 24 (midnight) 1971.
  2. Land and tenancy record
  3. Citizenship certificate.
  4. Permanent residential certificate.
  5. Refugee Registration certificate.
  6. Any government issued licence/certificate.
  7. Government service/employment certificate.
  8. Bank or Passport office accounts.
  9. Birth Certificate.
  10. Educational certificate.
  11. court records/processes.
  12. Passport.
  13. Any LIC policy.
List B includes:
  1. Birth Certificate.
  2. Land document.
  3. Board/University certificate.
  4. Bank/LIC/Post office records.
  5. Circle officer/Gram Panchayat secretary certificate in case of married women.
  6. Electoral roll
  7. Ration Card
  8. Any other legally acceptable document.
So in worst case only two documents will be asked to produce.  Also some sources claim that even if one has some post office letter/post card of date before 24 March 1971 (midnight) can be produced as proof.
In case somebody do not hold land on his name, but used to stay on and provided on lease or by Gram Panchayat in that case lease or tenure documents can be obtained from Lekhpal (accountant) since Lekhpal keeps the record  of all the land and the one who owns or authorized to use it.

Above information is based on the NRC rules in Assam, for the nationwide  NRC,  rules will be different and will be under The Citizenship Rule-2003. An explainer shared by officials said no documents will be required for pre -1971  lineage. Another explainer also gives liberty to "illiterate" in case he/she has no documents, by allowing witness and community verification.

Suggestions for corrections in this article is welcomed.

The Truth of Citizenship Amendment Bill-2019

India is witnessing a mass protest by students of Jamia Millia Islamia,  Aligarh Muslim Univesity(AMU) and Jawaharlal Nehru University against a new proposed bill in Lok Sabha (Lower House of Parliament ) now passed from Rajya Sabha as well.
So here is an effort to give a clear view of CAB, and why it is Need of Hour.

What is CAB?
As mentioned in the bill, It is A Bill further to amend the Citizenship Act 1955. Some new provisions have been inserted in this new proposed bill, which includes

Purpose of Bill:
The second point of Bill goes as,
1) "Provided that any person belonging to Hindu, Sikh, Buddhist, Jain, Parsi or Christian community from Afghanistan, Bangladesh or Pakistan, who entered into India on or before the 31st day of December 2014 and who has been exempted by the Central Government by or under clause (c) of sub-section (2) of section 3 of the Passport (Entry into India) Act, 1920 or from the application of the provisions of the Foreigners Act, 1946 or any rule or order made thereunder, shall not be treated as illegal migrant for the purposes of this Act;".
  
The purpose of this act is to provide citizenship to the minorities of aforesaid three countries who have been persecuted on the religious ground.
The aim is of addressing the minorities in these neighboring nations, these countries are non-secular and have Islam as their religious identity, minorities in these countries are continuously face discrimination, mental and in countries like Pakistan, reportedly are being forcefully converted to practice Islam, also many cases of molestation keeps on happening which make the life of minorities hell and they have no other option to find a place like India to stay. 

Many give the example of Sri-Lanka giving the example of Tamils in the country, but the reason to not address them is they are not being identified on religious grounds but whatever they face over is the political issue rather than religious.

Addressing Indigenous identity of Eastern India:
The protest by the Assamese in order to protect their indigenous identity seems as provoked action rather than reaction. Point four of the new bill goes as follows,

2) Nothing in this section shall apply to the tribal area of Assam, Meghalaya, Mizoram or Tripura as included in the Sixth Schedule to the Constitution and the area covered under "The Inner Line" notified under the Bengal Eastern Frontier Regulation, 1873.

The third point it is addressing is related to Overseas Citizens of India, it is for the cancellation of registration as Overseas Citizen of India, the points eight and nine of the bill are as follows,

3) Presently, there is no specific provision in section 7D of the Act to cancel the registration of Overseas Citizen of India Cardholder who violates any provisions of the Act or any other law for the time being in force. It is also proposed to amend the said section 7D so as to empower the Central Government to cancel registration as Overseas Citizen of India Cardholder in case of violation of any provisions of the Act or any other law for the time being in force.

  4) Since there is no specific provision in the Act at present to provide an opportunity of being heard to the Overseas Citizen of India Cardholder before cancellation of the Overseas Citizen of India Card under section 7D, it is proposed to provide the opportunity of being heard to the Overseas Citizen of India Cardholder before the cancellation of the Overseas Citizen of India Card.  

It is very clear from the discussion of the bill, it has nothing related to Indian Muslims, the only thing it does is that the bill is not addressing the majority of these countries since they are already enjoying all kinds of freedoms and are a proud citizen of their country.

The most important question that is asked by those who consider themselves as great thinkers and well-wishers of the nation is, what was the need for this bill at this point in time?

The Need:
I find it should have been done earlier, the reason being the way influx took place or the infiltration is taking place if it is not addressed in a proper manner a load of the population will cripple the nation and economy. Running a nation is not an easy task and really has a lot of responsibilities.
If the nation is unknown about its population, it will fail in all the fronts be it security, economy or any other aspect of a prosperous nation. 
Also, if people are coming to your country probably things have exceeded the maximum tolerance level and they are bound to leave their country.
If this problem were not addressed in a systematic manner it would have lead to economic and security disaster in India. A nation should know its population in order to be successfully run.
Rather than allowing backdoor entry, or infiltration it is good to have a proper system and knowing what population is residing in the nation. This will clear the security concerns of the nation as well as won't let economic load sunk the nation.
In fact, it is appreciable and clap-able step by the nation that instead of keeping vote bank on priority it is keeping nation first.


The protest gives message to the educated class of people who have gone through the new bill, that protesters are intolerant about giving shelter to people who do not belong to the community they belong to, but scenario may be different than those protesting have been ignited in the wrong direction to fulfill personal political agenda, ignoring consequences on International platform.

The logic that students of three prestigious institutes are doing protest including non-Muslims means there must be something that is not right in the bill is sophistry, before coming out on the road please once go through the  CAB bill.

Are We Human????

The actions taken by the police in Hyderabad were not appropriate for a democratic system. This case could have been resolved through the judicial system, and such cases should be handled within a specific timeline. While the accused could be publicly hanged, it should be done democratically. Lynching and encounters are not solutions to any problem. The government should enact stricter laws to protect girls in the country.

After the Nirbhaya case in 2012, we did not learn any lessons. Thousands of rape cases have occurred since then, and hundreds of fast-track courts were established, but have we seen any results? A big NO. We must review our past actions to make our country safer for girls. I see no signs of progress. It is really disappointing that the world now sees India as the "Rape Capital." There is no single city where girls can walk alone safely at night. There are many questions to answer, but the biggest one is, who will provide the answers?

Our social structure is unbalanced, and there are many insecurities in society. We—people, society, the nation, religion, corporations, media, government, democracy, and the judiciary system—are all responsible for this environment. It has been 72 years since we gained independence, but do you think we have truly achieved freedom? A big NO again. At that time, we were slaves to the British; now, we are slaves to these democratic bandits. One of them once said, "Boys will be boys; they make mistakes in their youth." We are slaves to a male-dominant mentality that suggests men can do anything.

We are also slaves to a judiciary system that takes decades to decide whether the accused is guilty or not. We are slaves to thoughts planted by media houses that don't understand the seriousness of the matter and view every news story as just a way to boost their ratings. Families are responsible for this too, as they dictate what girls should wear, where they can go, how to sit, and how to stand. Yet, they fail to teach their sons how to behave, manners, the value of girls, and that they are actually equal. They don't teach them what should matter and what should not. Society is also responsible, as it always brings in aspects of religion and caste into these crimes.

Our society is lagging in moral values. This era should be about teaching everyone lessons and making everyone civilized. Moral values and proper sex education must be integrated into the education system from the root level. People need to learn how to behave with girls and women. We often place girls on a pedestal, calling them goddesses, yet our actions do not reflect that respect. Don't give them divine titles—just treat them like human beings. That would be a great start.

We can't solve this problem with candle marches alone. No one can solve this problem by themselves. We, the people, the government, society, and the judiciary system all need to come together to address this issue. We are late, but much can still be changed if we start today. If we don't work to solve this, future generations and Bharat Mata will never forgive us. We have the chance to rise and do something. As someone wisely said, "All's well that ends well." We must create an environment for the upcoming generation where they can live without these problems.

रावण होना भी आसान काम नहीं


हर वक्त का एक रावण होता है और रावण का भी एक वक्त होता है, तब के रावण और आज के रावण में बहुत फर्क है| तब का रावण आज के लोगों से बहुत भला था, अगर आज मनुष्य रावण जैसा भी हो जाए तो दुनिया की काफी समस्या समाप्त हो जाए |

हर वक्त का एक रावण होता है और रावण का भी एक वक्त होता है, तब के रावण और आज के रावण में बहुत फर्क है| तब का रावण आज के लोगों से बहुत भला था, अगर आज मनुष्य रावण जैसा भी हो जाए तो दुनिया की काफी समस्या समाप्त हो जाए| आज हम रावण को जलाते हैं क्योंकि उस रावण को नहीं जलाएंगे तो दुनिया हमारे अंदर के रावण को देख लेगी | अगली बार जब कभी भी हम रावण को जलाने जाए तो इस बात पर ध्यान रखें कि हम कम से कम रावण से अच्छे हैं या नहीं क्योंकि रावण भी होना एक आसान काम नहीं है |

रावण होने के लिए रावण जैसा पुरुषार्थ होना चाहिए, जिसके घर पर ब्रह्माजी भी दैनिक कार्य करने जाते हो इतना महान बलसाली शासक जिसने सीता का हरण किया परंतु वरण नहीं किया, जिस देश में हर 30 मिनट में एक महिला का रेप हो उस देश को रावण जलाने का कोई अधिकार नहीं है |

रावण होने का मतलब यह भी है कि अपनी परिवार रक्षा के लिए पूरी दुनिया से लड़ जाना फिर सामने चाहे विष्णु अवतार श्रीराम ही क्यों न, थोड़ा सा यश पानी पर ही अपनों को भूल जाने वालों आपको भी रावण जलाने का कोई अधिकार नहीं है | रावण के तो सिर्फ दस सर थे, जो दिखते थे । अब तो लोगों के अनगिनत सर हैं जो नही दिखते है रावण को जलाने से पहले।

Double Standard of Indian Courts??

Maa Tripureshwari Temple Case

History of Temple:
Maa Tripureshwari Temple is Located in the Gomti District of Tripura state. It is one of the Shakti Peeth of Maa Sati and holds a really important place in Hinduism (Sanatan Dharma). It is said that in closing years of the 15th century the king got the dream ( Where Goddess asks him to offer Pooja, for proper cosmic balance and happy living of people) and built the temple for Goddess.

Case:
The case was brought to the court by former district judge Shubhash Bhattachaarjee, by filing PIL (Public Interest Litigation). The court in respond  on  27th September 2019 said that: "No person including the state shall be allowed to scarifies of any animal or bird within the precincts of any of the temples in the state of Tripura."
Court also said that: "Anyone of the devotees desirous of offering any animal out of personal faith, belief or desire, may do so but shall take back the animal and under no circumstances, any activity of animal sacrifices shall be permitted to carry out."

Pondering:
After the Sabarimala Case, it is one new case where court is interfering and hurting religious sentiments.  These ancient  Indian traditions being practiced for centuries.  It doesn't mean that I personally support the cruelty animals going through. But it creates doubt on the judiciary when it comes to other cases.

The title of an article published in 2015, I can still remember goes "SC rejects plea to ban animal sacrifices in festivals", after going through this article again it reminded me that it was time after Bakra-eid where the court said that it can not intervene in centuries-old customs.
Bombay High court case was the about the right place for the slaughtering of Buck, but the question is, what courts and governments are doing, it all sounds like "Selective Secularism".

It's not about any particular religion but the question is about what actually the pillars of a constitution are doing.
Judges or the judiciary seems to have different parameters for different religions. On the one hand in Jallikattu, Sabarimala & Tripureshwari Maa cases court instead of respecting religious sentiments developed from the period of hundreds of years, courts are intervening on the other hand in many cases it is saying that it can't intervene into it.

 This can bring two different conclusions either the judiciary has different criteria for different religions or the judges are giving decisions on the basis of their personal view.
In Tripureshwari Maa case there is another angle of the merger agreement that was signed between regent Maharani Kanchan Prabha Devi and Indian governor-general, which will be made as a base by the state of Tripura to further appeal in the supreme court.

The doubt and the point of discussion are about having different parameters for the judgment, or the Judgement is adulterated with a personal view ??  In both cases common men doubt policymakers, influencing decisions, which don't seem to have a good impact on the temperament of people.

 I would like to clear my stand, that I don't support any kind of inhuman behavior with animals, neither I have any problem with any of the religion.
 I felt important to clear my stand else many are ready to point you on the basis of their limited parameters.


Common  Note : I respect and support the decision of Supreme Court, and have full faith in it.

The Life Element

 Imagine that we are left with only a few thousand liter of water, and god allows us to drink the water with certain terms & Conditions,

What will happen if God merges our Souls into water that we have? and gives the following conditions
1: That if even a single drop of water is wasted, the one who does so will lose his/her close one
2: We can arrange water from somewhere else if possible but without harming any life that we can see from our eyes.
Put yourself into this condition!! Think!!
Now, what is the value of water for you??

 We all are aware of how to use water and how it is the Essential  Life element to us. We have evolved to the time where we are talking about automation, AI, ML and what not; but have failed to understand the importance of Water.
 We have failed to give importance that water,, air and the food deserves. Yes in certain culture around the world people gave importance to the limit that they worshiped all these Life Elements.

For the modern world, it was a fake system of belief, unnecessary importance etc , were complaints of young generations. But today we understand how important those practices were.
The world our elders gifted us was more beautiful, organized and stress less. They lived in harmony with nature and surrounding, they never exploited instead there was a balance. Human beings and nature lived as two sides of the coin, the way brothers of mother nature should live. Without fighting and mess.  But with time we ignored the importance of our brother, here we are standing discussing its significance.

Understanding Water Scarcity:


Chennai this year   2019, almost ran out of the water, Cauvery River is drying at a pace of about 6 to 8 kilometers every year. The river is unable to reach up-to the sea. You might have heard of Cauvery water dispute if not you will get sufficient information on Wikipedia (https://en.wikipedia.org/wiki/Kaveri_River_water_dispute) similarly there is the rise of disputes about water every year.

According to the report of NITI AAYOG, the major cities including Bangalore, Chennai, Hyderabad etc will run out of ground water by year  2020 i.e Day Zero . We have finished the repository to this level that now if don't take action the coming generation will Curse us. Its time to be responsible enough to store the nature and gift a beautiful planet to our coming generations.

 Every new research advancement in technology will be futile if we don't wake up early and abide our duty towards nature and future generations. Water scarcity is hitting so many nations around the globe. Just open up your eyes and be sensitive enough. Education is of no worth if we don't take any step. I have heard people discussing the importance of practical knowledge, implementing scientific concepts, but implementing our understanding towards nature all the data and everything is of no use until we start understanding our duty and urgency to take action.

 All AI and ML will fail that day when we will have no water to drink. There is this famous line in Hindi अभी  नहीं तो कभी नहीं  which means NOW or NEVER.

If our lives were in water drops, with each wasting drop of water we had been loosing one life on earth. This is the urgency  we need to show to save water.

यह हमेशा से कहा गया है की समय बहुत मूल्यवान है, समय के साथ सब बदलता रहता है | जो समय के साथ नहीं चलता वो समय से पीछे छूट जाता है और जो समय से आगे चलने की ज्यादा कोशिश करता है उसे भी बहुत सारी मुश्किलों का सामना करना पड़ता है| इसीलिए बड़े बुजुर्ग कहते हैं की समय के साथ चलना चाहिए |

इस दुनिया में ऐसी बहुत सारी चीजें हैं जो हम नियंत्रित नहीं कर सकते, समय उनमें से एक है | इसको हम अपने कर्तव्यों  से एक दिशा कर सकते हैं | भगवान श्री कृष्ण ने भगवत गीता के तृतीय अध्याय के 19 वें श्लोक में कहा हैं की,
                                        "तस्मादसक्तः सततं कार्यं कर्म समाचर ।
                                         असक्तो ह्याचरन्कर्म परमाप्नोति पुरुषः ॥"
भावार्थ: अत: कर्म फ़ल में आसक्त हुए बिना मनुष्य को अपना कर्तव्य समझ कर कर्म करते रहना चाहिये क्योंकि अनासक्त भाव से निरन्तर कर्तव्य कर्म करने से मनुष्य को एक दिन परमात्मा की प्राप्ति हो जाती है।

अर्ताथ हमें कर्तव्य करते जाना है, फल अवस्य ही मिलेगा | हमारे लिए समय पर ही कर्तव्य करते जाना सर्वोपरि है, समय पर जो भी हमें करना हैं वो पूरा होना चाहिए क्योंकि गया हुआ समय वापस नहीं आता |

किसी भी कार्य को जब भी हम  कर रहे होते है तो बहुत सारी मुश्किलें आती है परन्तु हमें  डंट के सामना करना है |  समय हमेशा हमारा मूल्यांकन करता रहता है | जब भी कभी मुश्किल घडी ख़त्म हो और हम पलट के कर के देखें की हमने क्या किया तो अपने किये हुए पे हमें खेद ना हो |

समय परिवर्तनशील है, यंहा पर कुछ भी निरंतर नहीं है, यह आवश्यक नहीं है जो भी हमारे  साथ शुरू में है वो आपके वह हमारे साथ आखिरी तक रहें | आदि और अनन्त में में सब कुछ समान नहीं हो सकता है, अगर हैं तो हमने कर्म ही नहीं किया है|  इस सफर में हमारे कुछ करीबी हमारा साथ छोड़ जायेंगे, कुछ हमसे रास्ता बदल लेंगे | यही संसार का नियम है क्योंकि भगवान श्री कृष्ण ने भगवत गीता के तृतीय अध्याय के वें श्लोक में कहा है,

                                                 "न कर्मणामनारंभान्नैष्कर्म्यं पुरुषोऽश्नुते ।
                                                  न च सन्न्यसनादेव सिद्धिं समधिगच्छति ॥"
भावार्थ : मनुष्य न तो बिना कर्म किये कर्म-बन्धनों से मुक्त हो सकता है और ना ही कर्मों के त्याग (सन्यास) मात्र से सफ़लता (सिद्धि) को प्राप्त हो सकता है।

सभी को सुचित या अनुचित कर्म करना ही पड़ेगा इसीलिए अगर कोई हमसे विमुख हो तो इसका मतलब यह बिलकुल नहीं है वो गलत है या हम सही है क्योंकि हम जो भी कर्म करेंगे उसके तदर्थ ही हमको फल की प्राप्ति होगी | हमें उनके योगदान को याद करना चाहिए जो जब हमारे साथ थे और जब हमसे अच्छा व्यवहार किया | संसार में कुछ भी अस्थायी नहीं है इसीलिए जो हमारे है हमें उनका उचित सम्मान करना चाहिए |

महान कवि रहिम दास जी नें कभी कहा है,
                                           "समय पाय फल होत है, समय पाय झरि जात |
                                               सदा रहै नहीं एक सी, का रहीम पछतात" ||
इसीलिए हमें सभी के साथ समान व्यवहार करना चाहिए,धन के आधार पे या किसी और भी तरीके से हमें लोगो का वर्गीकरण नहीं करना चाहिए | हमारी मातृभाषा जब सबके नाम के साथ एक जैसा व्यवहार करती है, सबके नाम एक जैसे लिखे जाते है, एक जैसे पढ़े जाते है तो हमें कोई अधिकार नहीं है लोगो को अलग करने का | संसार के सभी प्राणियों से प्रेम करिये एवं प्रेम का सन्देश फैलाइये |
भारत माता को गर्वान्वित करने किये कर्मठ कीजिये, सनातन धर्म को आगे बढ़ाने में अपना योगदान दीजिये |
प्रभु श्री सीताराम जी की कृपा आप पर और आपके चाहने वालो पर बनी रहै ||

Please stop posting about Kashmiri land and Kashmiri brides. This is the time to show that we are united. The whole world is watching us, and our behavior will determine the future of Jammu & Kashmir. People there are worried about their families due to the network ban. If you know anyone from Kashmir, meet with them, give them a hug, and make them understand that these changes are for their development. Assure them that they are a part of us and that we are with them in every possible way.

So please stop spreading nonsense and behave like mature citizens. The government has done its part; now it is our responsibility. Let’s not create chaos.
